Mark net without poly

I was trying to mark a net using mark net option in the layout which have poly resistors in it.
This causes  me a problem since poly act as a short in mark net. Is there any script which ignores the poly?

I can't remember quite when this was introduced, but there's a choice on the Options form for Mark Net (hit F3 once the command has been started) to set the Via Layers used in Mark Net. You can then omit any vias (contact) which connect to poly.

It's certainly there in current IC5141 versions.
