Dynamic copper fill problem(?)

I have a design that requires a copper fill on the top etch. I am using v15 and have set the global params as needed and then assign the net and create the shape using polygon. After completion, there ae several places where the traces that do NOT belong to the copper fill net, are "shorted" to the copper fill and no void is made around them. Why is this? Am I missing something?
