Mark Net and vias

Hello,

I have the situation from the top of the attached image , where layer 1 and layer 3 are partial overlapping through layer 2;

When using Mark Net, I hit F3 and select "Display Via Layers" and add the combination: "Layer1 Layer2 Layer3" , then Mark Net works well: When I click over the layer1, Mark Net highlights correctly entire "path" Layer1-Layer2-Layer3

BUT

(the bottom part of the attached image)

if, in place of the layer2 shape, I use a VIA (Create - Via; the two main layers defind in tech for this via are different than Layer1 and Layer3) which has inside it the layer2, then MarkNet does not work anymore !! I would espect that markNet would highlight, as in previous example, Layer1, Layer2 inside via, Layer3 but this is NOT hapening;

 

Currently the only solution is to flatten the VIA and then MarkNet works; 

Is this normal? What other solutions there are?
